Terms of Use
By accessing or using the TransUnion web site, transunion.hk, (the "Site"), mobile application (“TransUnion Mobile”), content or our products and/or services, you agree to be bound by these terms of use (“Terms of Use”). These Terms of Use, together with the Service Agreement, the Privacy Policy are the “Agreements” and contain the terms and conditions upon which you ("you," or the “Subscriber”) may access TransUnion® products and services through the Site or TransUnion Mobile. By using any of the products or services provided by TransUnion Credit Information Services Limited and/or its affiliate TransUnion Limited) (together, “TransUnion”, “our” or “we” or “us”), you agree to be legally bound by the terms and conditions of the Agreements. If you do not agree with the terms and conditions of the Agreements or you do not want to be bound by them, then do not use any TransUnion® products or services (including subscription offerings), or access or use the Site or TransUnion Mobile.
Your order of, acceptance of, use of, and/or access to, our products, services, related websites and content constitute your agreement to abide by each of the terms set forth herein.
You must accept the terms of the Service Agreement before you will be permitted to enroll in, register for, purchase or use the products, services or other offerings.
While you are on the Site or TransUnion Mobile or are using or accessing any of our product offerings, we may collect certain data about your use of the Site, TransUnion Mobile and our Products/Services (defined below). By accessing or viewing any of our Site or TransUnion Mobile, you understand that we will be collecting your data. If you do not want us to collect your data about you, then do not access any of our Site, TransUnion Mobile and do not enroll in, purchase, or use any of our Products/Services.
General Terms
TransUnion maintains the Site and TransUnion Mobile to provide you with information about our TransUnion® Credit Report, Credit Score, Credit Lock, Dark Web Monitoring, Credit Alerts, calculators, simulators, debt analysis, TransUnion® Offers, special services or any or of our other products and/or services through our Site or TransUnion Mobile (collectively referred to as “Products/Services”) and to facilitate communication with us and our affiliates. These Products/Services will be provided for the period stated in the product description. Please see the Service Agreement or terms about the specific features included in the TransUnion® products, services, and subscriptions.
Use of the Site, TransUnion Mobile, Content and Products/Services
Except as expressly provided in these Terms of Use, any reproduction, retransmission, distribution, sale, republication, modification, translation of or creation of derivative works based on the Site or TransUnion Mobile, the Content (as defined below) and/or Products/Services, in whole or in part, and any decompilation, disassembly, reverse engineering or other exploitation of the Site, TransUnion Mobile or our Products/Services is strictly prohibited. Except as expressly provided in these Terms of Use, you acquire absolutely no rights or licenses to the Site, TransUnion Mobile, the Content or our Products/Services other than the limited right to use the Site, TransUnion Mobile, the Content and our Products/Services in accordance with these Terms of Use.
You shall not transmit, communicate, upload, post, publish on or through the discussion forum of the Site any unlawful, harmful, offensive, threatening, abusive, libelous, harassing, defamatory, vulgar, obscene, profane, hateful, fraudulent, sexually explicit, racially, ethnically, or otherwise objectionable material of any sort, including, but not limited to, any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international laws.
Postings that are not related to the topic or posted multiple times will be removed and the user may be banned from future postings. Solicitations or commercial advertisements are prohibited.
You shall not upload or transmit any material that may infringe or misappropriate any person's copyright, patent, trademark, trade secret, or disclose via the Site or TransUnion Mobile any information the disclosure of which would constitute a violation of any confidentiality obligations you may have.
You shall not upload any viruses, worms, Trojan horses, or other forms of harmful computer code, nor subject the network or servers to unreasonable traffic loads, or otherwise engage in conduct deemed disruptive to the ordinary operation of the Site or TransUnion Mobile.
Policy on Links to the TransUnion Site or TransUnion Mobile
You are given a limited, non-exclusive right to create a hypertext link to the TransUnion home page (www.transunion.hk) . However, you may not portray TransUnion or any of our Products/Services in a false or offensive manner. Also, you may not misrepresent your relationship with TransUnion or imply that TransUnion sponsors, endorses, or is affiliated with your web site or products. You may not replicate, modify, or alter the appearance or content of this Site or TransUnion Mobile. You may not use, frame, or utilize any framing techniques to enclose any TransUnion Trademarks (as defined below) or any of the content of this Site or TransUnion Mobile. Except as stated above, you are not given any other right or license to (i) the content of this Site or TransUnion Mobile or (ii) any intellectual property or proprietary rights of TransUnion. This limited linking right may be taken away from you at any time at our sole discretion.
New Services and Modifications and Updates
Whenever new products or services are introduced on the Site or TransUnion Mobile as part of our Products/Services, your use of such Products/Services will be subject to these Terms of Use unless we notify you otherwise. We reserve the right, in our sole discretion, to modify or update these Terms of Use at any time and from time to time. We will notify you of any material changes to these Terms of Use by notice on this Site or TransUnion Mobile. Any material changes shall be immediately effective on the notice date, except minor changes of these Terms of Use for consistency or clarification purposes will take effect as and when they are made without posting notice on the Site or TransUnion Mobile. Your continued use of this Site or TransUnion Mobile after posting of the notice means that you agree to and accept these Terms of Use as amended. If you do not agree to any modifications of these Terms of Use, you must immediately stop using this Site or TransUnion Mobile.
Term and Termination and Modification
These Terms of Use will take effect and become binding on you at the time you click "I Accept & Continue" at the time of purchasing or subscribing to any Products/Services on this Site or TransUnion Mobile and shall terminate (a) when you give written notice of your intention to cancel your subscription by contacting TransUnion via the Site or TransUnion Mobile; (b) upon termination of your subscription; (c) if TransUnion discontinues providing any subscription, subject to your right to receive subscription benefits that you have paid for or to obtain a refund of a portion of your payment; or (d) for any reason at any time in TransUnion’s sole discretion. Our Products/Services shall not be used to defraud or otherwise in a manner that abuses the credit reporting or credit scoring systems. TransUnion has the right to suspend or terminate your use of any of our Products/Services or access to our Site or TransUnion Mobile if we determine, in our sole discretion, that your use of our Products/Services has abused the credit reporting or credit scoring systems. Further, you agree that TransUnion will not be liable to you or any third party if TransUnion suspends or terminates your access for any reason.
TransUnion may (i) change these Terms of Use or the feature of our Products/Services for subscription, or (ii) change the Site or TransUnion Mobile, including eliminating or discontinuing any content or feature of the Site or TransUnion Mobile, restricting the hours of availability, or limiting the amount of use permitted, by providing you a notice of such modification, and all such changes shall be immediately effective on the notice date (except minor changes of these Terms of Use for consistency or clarification purposes will take effect as and when they are made). Your continued use of this Site or TransUnion Mobile and/or your subscription means you agree to and accept all changes. You are expected to review the Site or TransUnion Mobile periodically to ensure familiarity with any posted notices of modification.
Verifying Your Identity
In order to process your transactions and provide you with services, we need you to confirm and help us verify that the person requesting your personal data or credit report really is you and not an impostor or other person improperly seeking to access your information. You hereby give your consent to and authorize TransUnion to :-
(a) use, process all information, including any photo images, videos, or documents, provided by you, and match against each other; and
(b) access all or part of your consumer credit data which may be held from time to time by the Selected Credit Reference Agencies under Credit Data Smart (also known as the Multiple Credit Reference Agencies Model) in their databases (“Your Credit Data”) and to match all or part of Your Credit Data and other data in (a) above against the information you provide,
for the purpose of verifying your identity, documents or any information, and to monitor, detect and avoid fraudulent transactions on your account on our Site or TransUnion Mobile.
Privacy
By accessing or using this Site and/or TransUnion Mobile, you are consenting to our collection, use and disclosure of your personal information in accordance with the Privacy Policy.
Registration and Accurate Information
If you decide to register on our Site and/or TransUnion Mobile, purchase our Products/Services or participate in our affiliate program, contests or surveys, you may be required to register, provide personal information, and select a user name and password. You agree to provide accurate information in your registration and not to share your password with third parties. You agree not to impersonate any person other than yourself or to select or use the user name or password of any another person. You agree to notify TransUnion promptly of any unauthorized use of your account and of any loss, theft or disclosure of your password. Failure to comply with these requirements shall constitute a breach of these Terms of Use and shall constitute grounds for immediate termination of your account and your right to use the Site or TransUnion Mobile.
Disclaimer of Warranties and Liability
Our Products/Services offered on the Site or TransUnion Mobile are provided "as is", with no representations, warranties or conditions of any kind, whether express, implied or statutory, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. Use of the Site or TransUnion Mobile, the content and our Products/Services is at your own risk. TransUnion do not make any representations, warranties or conditions about the quality, accuracy, reliability, completeness, currency, or timeliness of the Site or TransUnion Mobile, the Content or our Products/Services. TransUnion do not assume any responsibility for any errors, omissions or inaccuracies in the Site or TransUnion Mobile, the Content or our Products/Services.
TransUnion is not a credit repair organization, or similarly regulated organization under other applicable laws, and do not provide credit repair advice. All tips, suggestions and score calculator on the Site or TransUnion Mobile are for reference only and do not form as any professional advice from TransUnion to you. The Content or our Products/Services are provided for informational purposes only and is not intended to provide financial advice to you and you should not rely upon the Content or our Products/Services to provide any such advice. You should seek the professional advices regarding the evaluation and verification of any content provided on the Site or TransUnion Mobile and, in any event, prior to making any financial decisions based on such content.
Credit score, score factors and score calculator do not draw conclusion or provide credit decisions for credit providers, as credit score is only one piece of information used by credit providers in their credit assessment process. Other than the credit score, credit providers shall make own judgment of their own risk acceptance level, their own internal credit score and the applicant’s demographic and financial information upon lending. A credit score is a fluid number and is calculated based upon the latest information contained in a credit file at the time the score is requested. Since the credit information of a consumer may change from time to time, a score generated previously may not be the same as the current one. The score factors and score calculator are analyzed based on the information contributed by credit providers at the time when the credit report was generated, with certain assumptions. It serves as a reference only. It is not advisory information for your credit management and will be updated from time to time. Moreover, the same credit applicant with the same score may be accepted by one credit provider, but rejected by another. Such decisions depend on the credit policy of the credit providers and/or other available information. We are not involved in any of such credit decision process.
To the maximum extent permitted by applicable laws, TransUnion and its subsidiaries and affiliates disclaim all warranties, representations and conditions of any kind with respect to the Site or TransUnion Mobile, the Content and our Products/Services whether express or implied, including, without limitation, the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement or that the Site, TransUnion Mobile, the Content and/or our Products/Services are or will be error-free or will operate without interruption. In no event will TransUnion and its subsidiaries and affiliates be held liable, whether based on warranty, contract, tort, negligence, strict liability or any other legal theory, for any damages of any kind (including, without limitation, direct, indirect, incidental, consequential, special, exemplary, punitive damages, lost profits, loss of use, loss of data, personal injury, fines, fees, penalties or other liabilities), whether or not TransUnion and its subsidiaries and affiliates are advised of the possibility of such damages, resulting from the use of, or the inability to make use of, the Site, TransUnion Mobile, the Content or our Products/Services.

The images, text, screens, web pages, materials, data, content and other information used and displayed on the Site or TransUnion Mobile, including but not limited to the mark TransUnion®, or articles, videos, infographics, blogs, and other creative materials found on or TransUnion Mobile, the Site or other websites owned or maintained by TransUnion and/or its subsidiaries and affiliates ("Content"), are the property of TransUnion and/or its or the applicable subsidiary or affiliate or its licensors, and are protected by copyright, trademark and other laws. In addition to our rights in individual elements of the Content within the Site or TransUnion Mobile, TransUnion owns copyright or patent rights in the selection, coordination, arrangement and enhancement of such Content. Severability
